Terms of Service.

These terms are an agreement between you and BDMG Enterprises Pty Ltd (ABN 82 636 813 299, ACN 636 813 299), trading as The Shelf, of Sydney, Australia. By creating an account or using The Shelf at theshelfos.com, you agree to them.

The short version. Your data is yours and you can take it with you at any time, including if you stop paying. Pay for a year, get a year. Don't use it for anything illegal. We've built this carefully but it's a tool, not a guarantee — keep your own records for anything that really matters.

1. Your account.

2. Plans and payment.

Free.

The free plan includes up to 50 items and 1 space, with photo entry, AI auto-fill and reminders. We may change what's included on the free plan, but we'll give existing users reasonable notice before reducing anything.

Pro.

Pro is A$75 per year, billed annually in advance, and includes unlimited items, unlimited spaces and unlimited AI auto-fill. Prices are in Australian dollars and are inclusive of GST for Australian customers. A tax invoice showing our ABN and the GST component is available on request.

Billing.

Cancelling.

You can cancel at any time from the billing portal — enter your email and you'll be sent a link to manage your subscription, update your card or view invoices. You can also cancel by emailing sean@bigdaymedia.com.au. Cancellation takes effect at the end of your current paid period — you keep Pro access until then. We don't provide pro-rata refunds for partial years, except where required by the Australian Consumer Law or where we've clearly got something wrong. If you're within 14 days of your first payment and it isn't working out, email us and we'll refund you.

Price changes.

We may change pricing, but we'll give existing subscribers at least 30 days' notice before a change takes effect at their next renewal. You can cancel before then if you don't want to continue.

3. What happens when a subscription ends.

If your Pro subscription lapses or is cancelled, your data stays. Nothing is deleted, nothing is held hostage. Your account moves to the free plan: you keep full access to view and export everything you've catalogued, and you can continue using the app within free plan limits. You simply can't add beyond those limits until you resubscribe.

Export remains available on every plan, at all times, including after lapse. This is a deliberate commitment and we won't change it.

4. Your content.

Everything you put into The Shelf — your item records, photographs and organisational structure — remains yours. We claim no ownership of it.

You grant us a limited licence to store, process, transmit and display your content solely for the purpose of operating the service for you. That includes sending photographs and item text to our AI provider for identification and auto-fill, as described in our Privacy Policy. This licence ends when you delete the content or your account.

You're responsible for having the right to upload what you upload, and for not uploading anything unlawful.

5. Acceptable use.

Don't:

We may suspend or terminate accounts that breach these terms. Where it's reasonable to do so, we'll contact you first and give you a chance to export your data.

6. This is a record-keeping tool, not a guarantee.

Please read this one properly. The Shelf helps you keep track of your equipment. It is not an insurance product, a professional valuation, a security system, or a certified asset register.

AI-generated item names, categories, descriptions and any value estimates are suggestions and may be wrong. You should check them. Do not rely on The Shelf as your sole record for insurance claims, tax depreciation, legal proceedings, or anything else where an error would cost you. Keep independent records and receipts for anything that matters, and use the export function regularly.

7. Availability.

We work to keep The Shelf running and your data safe, but we don't guarantee uninterrupted or error-free service. We may need to take the service down for maintenance, and we may change or remove features. Where a change materially reduces what paying subscribers get, we'll give reasonable notice.

We maintain backups, but you should use the export function periodically to keep your own copy. That's what it's there for.

8. Australian Consumer Law.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes those rights.

Subject to those guarantees, and to the extent permitted by law: The Shelf is provided "as is"; we exclude all other warranties; and our total liability to you for any claim relating to the service is limited, at our option, to resupplying the service or refunding the amount you paid in the 12 months before the claim.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data beyond our reasonable control.

9. Beta and complimentary accounts.

Some accounts have been granted complimentary access during beta. Complimentary access is provided at our discretion and may be changed with reasonable notice, but we won't retroactively charge for a period already used. If you were part of the beta, we'll tell you clearly before anything about your access changes.

10. Changes to these terms.

We may update these terms. If a change is material we'll notify account holders by email and update the date above. Continuing to use The Shelf after a change takes effect means you accept the updated terms. If you don't accept them, cancel and export your data.

11. Termination.

You can close your account at any time by emailing us. We may suspend or terminate accounts for breach of these terms, or if we discontinue the service — in which case we'll give you reasonable notice, a refund of any unused prepaid period, and time to export everything.

12. Governing law.

These terms are governed by the laws of New South Wales, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.
